Chapter 1. General Provisions
Article 1 (Purpose)
These Terms set forth the rights, obligations, responsibilities, and other necessary matters between 365mc Hospitals/Clinics ("365mc") and users in connection with the use of 365mc's medical services and other related services.
Article 2 (Terms and Definitions)
The terms used herein have the following meanings:
- 365mc: All hospitals/clinics belonging to the 365mc network.
- Branch: The specific 365mc location where a user has entered into, or intends to enter into, a contract for medical services such as treatment or surgery.
- User: Any customer who has entered into, or intends to enter into, a contract for medical services (including treatment or surgery) with 365mc.
- Fees: Charges for 365mc's medical services.
- Services: All medical services provided by 365mc, including consultation, prescription, procedures, treatments, and surgeries.
- Contract: The agreement for provision of medical services between 365mc and the user.
- After-care Period: The period during which additional after-care services are provided for procedures and surgeries under the Contract.
- Special Observation Period: A period not exceeding one (1) year after a procedure or surgery during which, if objective adverse effects occur based on 365mc's medical judgment, treatment services are provided and clinical observation is conducted.
- After-care Services: Services such as medical follow-ups and diet/nutrition counseling provided during the After-care Period.
- Prescription Period: The period during which prescription-issuance services are available to users who received a procedure or surgery.
- Condition Verification System: 365mc's operational policy to maintain the operating surgeon's optimal physical and mental condition for patient safety; with the user's prior consent, the operating surgeon or surgery date may be changed before surgery to ensure best-quality medical services.
- Practice Index: A program forming part of behavioral modification therapy to achieve long-term obesity-treatment goals; points are granted under set conditions and expire after the specified period.
Article 3 (Posting and Amendment of the Terms)
- 365mc shall post these Terms where users can easily access them, including on the website (www.365mc.com) and on-site.
- 365mc may amend these Terms within the scope permitted by applicable laws, including the Act on the Regulation of Terms and Conditions, the Medical Service Act, and the Consumer Protection Act.
- When amending the Terms, 365mc shall announce the effective date and reasons for amendment at least fifteen (15) days prior to enforcement.
- Users may express objection within 15 days of the announcement. If a user objects, the previous Terms apply to that user; if no objection is made within 15 days, the user is deemed to have consented.
- Matters not prescribed herein and interpretation of these Terms shall follow the Consumer Protection Act, relevant laws, and commercial practice.
Article 4 (Formation of Contract)
- A medical service contract executed at a Branch is, in principle, formed for that Branch only, and services are provided there. If, due to special circumstances of the user or the Branch, services must continue at another Branch, the user must apply and obtain consent from such other Branch; if consent is not granted, the Contract does not transfer.
- For quality improvement or other purposes, 365mc may, with prior notice, change medical service contents and quality, prices, or medical/surgical methods.
Article 5 (Fees, After-care Period, Special Observation Period)
- Fees are determined based on 365mc medical staff's diagnosis and the surgery, procedure, or package selected by the user. Details are available on the website (www.365mc.com) and on-site postings.
- The After-care Period applies only to users who received a surgery or procedure at 365mc; services are provided during the period and expire by lapse of time regardless of usage count.
- Surgery users: Up to 6 months from the date of initial surgery.
- Procedure users: Up to 2 months from the date of initial procedure.
- The Prescription Period applies only to users who received a surgery or procedure at 365mc; prescription services are available during the period and expire by lapse of time regardless of usage.
- Surgery users: Up to 6 months from the date of initial surgery (maximum 60 days' supply).
- Procedure users: Up to 3 months from the date of initial procedure (maximum 35 days' supply).
- During the After-care Period, 365mc may provide additional services—such as consultations, prescriptions, or procedures—to ensure optimal therapeutic outcomes. However, even during this period, 365mc may suspend or cancel after-care services if the user breaches these Terms, engages in harmful acts against 365mc, refuses legitimate medical instructions necessary for treatment, or if other reasons arise that make continuation of treatment infeasible.
- After the Prescription Period ends, fees apply for prescription issuance.
- If a user raises dissatisfaction based on objective evidence following surgery or a procedure, 365mc may, at its medical discretion, designate a Special Observation Period within one (1) year from the initial surgery date to provide direct treatment and follow-up management.
- As the Special Observation Period is a period during which treatment continues, refunds and compensation are not provided during this period.
Article 6 (Condition Verification System)
For surgery users, in order to ensure the medical team's optimal condition, the operating surgeon or surgery date may be changed—with the user's prior consent—at any time from contract execution until the surgery is performed.
Article 7 (Practice Index – 365mc Behavioral Points Program)
- The Practice Index is 365mc's proprietary behavioral points program, designed to support long-term obesity treatment through positive lifestyle habits and behavioral modification. Points are earned when users fulfill specific health, nutrition, or activity goals established by 365mc. These points may be used only for the user's own treatment purposes and are valid across all 365mc branches.
- The Practice Index has no monetary value and therefore cannot be transferred, sold, exchanged for cash, or used for any other financial or commercial purpose.
- The Practice Index remains valid for one (1) year from the date of issuance and will automatically expire thereafter without separate notice.
- The Practice Index is valid for one (1) year from issuance and expires automatically thereafter without separate notice.
- 365mc reserves the right to delete, modify, or discontinue the Practice Index program at any time for operational reasons, without assuming any liability to users.
- Practice Index points are granted only to users who have agreed to participate in the 365mc Practice Index program.
- When the Practice Index is used for any service, overlapping or duplicate benefits (including additional discounts or promotions) will not apply.
- Payments made using the Practice Index are non-refundable, and no points will be re-accrued in the event of a refund or cancellation.
- Points related to "Success Journals" or "Meal Diaries" will be granted only within six (6) months from the user's most recent procedure or after-care session.
- 365mc may, without prior notice, revoke or deduct points already granted to a user under any of the following circumstances:
- The user sells or trades points for profit beyond their intended purpose.
- The user induces or assists others to commit illegal acts for the purpose of obtaining points.
- The user engages in deception, fraud, or other dishonest conduct to earn points.
- The user uses points for unlawful or socially inappropriate purposes.
- The user seriously damages 365mc's reputation or brand.
- The user acquires points through any other improper or fraudulent means.
- If points are canceled or revoked pursuant to the preceding paragraph, any user who has already used such points for payment shall repay the corresponding amount in cash to 365mc.
Article 8 (365mc's Authority)
- 365mc may refuse to provide services in circumstances specifically set forth in the Medical Service Act.
- In principle, only the user may receive consultation in the examination room (minors excepted). Friends, family, or third parties may accompany the user only with the attending physician's consent.
- In accordance with the Medical Service Act, Personal Information Protection Act, and other applicable laws, 365mc may photograph before/after images and surgery videos, or record consultations.
- For materials submitted by users or lawfully recorded, 365mc may, after de-identification, use such materials for treatment, research, and consultation purposes.
Article 9 (Obligations of 365mc)
- 365mc shall endeavor in good faith to ensure users can receive services in a comfortable environment.
- 365mc shall comply with applicable laws and these Terms.
- 365mc shall protect personal information obtained from users.
- If the user incurs damage due to 365mc's willful misconduct or gross negligence during service use, 365mc shall compensate such damage.
Article 10 (User Rights)
Under the Medical Service Act and related laws, users have the following rights:
- The right to receive medical treatment;
- The right to be informed and to self-determination;
- The right to confidentiality;
- The right to request consultation and mediation.
Users are entitled to receive medical services in accordance with the Contract executed with 365mc.
Article 11 (User Obligations)
Under the Medical Service Act and related laws, users have the following obligations:
- The obligation to trust and respect medical professionals;
- The obligation not to obtain medical treatment by improper means.
- Users must provide 365mc with accurate and truthful personal and health information necessary for treatment (e.g., surgical history, current health status, medications, presence of implants, and other physical particulars). The user bears responsibility for any damage arising from failure to disclose such information.
- Users must pay in full the fees for surgery/procedure prior to the surgery/procedure date (including blood tests and garment production costs).
- Users may not transfer, gift, or entrust remaining services or their rights to any third party.
- On the day of surgery/procedure, users must refrain from self-driving, alcohol consumption, or strenuous activity due to potential dizziness or postoperative side effects. 365mc is not responsible for accidents or damages arising from the user's negligence.
Article 12 (Termination, Cancellation, and Refund Policy)
Refunds are provided in accordance with the Consumer Dispute Resolution Standards announced by the Korea Fair Trade Commission.
A. Surgeries (including LAMS)
(i) Termination due to the hospital's fault
- Cancellation 3 days or more before scheduled surgery: Return of deposit + compensation equal to 10% of the deposit
- Cancellation 2 days before: Return of deposit + 50% of deposit
- Cancellation 1 day before: Return of deposit + 80% of deposit
- Cancellation on the day of surgery or after: Return of deposit + 100% of deposit
(ii) Termination due to the user's fault
- Cancellation 3 days or more before: Refund 90% of the deposit
- Cancellation 2 days before: Refund 50% of the deposit
- Cancellation 1 day before: Refund 20% of the deposit
- Cancellation on the day or after: No refund of the deposit
B. Procedures (excluding LAMS)
(i) Termination due to the hospital's fault
- Before treatment begins: Return of deposit + 10% of deposit
- After treatment begins: Refund of paid amount minus the value of sessions used up to termination + compensation equal to 10% of the total treatment amount
(ii) Termination due to the user's fault
- Before treatment begins: Refund 90% of the deposit
- After treatment begins: Deduct the value of sessions used up to termination and an additional 10% of the total treatment amount
- If the user terminates the Contract or requests a refund before the reserved surgery/procedure date, any incurred costs (e.g., blood tests, garment production) and liquidated damages will be deducted from the refund.
- Changes to reservation dates due to the user's personal circumstances or mere change of mind are not permitted.
Article 13 (Side Effects and Precautions)
- Depending on the type of medical service and individual predispositions, side effects may occur. If any side effect occurs, the user must immediately contact the relevant Branch or the 365mc department (02-1577-3653) for guidance or corrective measures.
- Except in emergencies, the user must receive measures directly from 365mc. If the user fails to follow 365mc's instructions or obtains discretionary treatment elsewhere without 365mc's consent, 365mc bears no responsibility for the resulting outcomes or side effects.
Article 14 (Disclaimers, etc.)
- 365mc and the user are exempt from liability for failure to perform the Contract due to force majeure such as natural disasters.
- If 365mc suffers direct or indirect damage due to incorrect information provided by the user, the user shall compensate such damage.
- For user convenience, 365mc may provide lockers with locks free of charge. For valuables, under the Commercial Act, the user must request safekeeping from 365mc and declare the value; 365mc bears no responsibility for items not separately stored.
- 365mc's principle is to provide the best possible medical services. Users shall not hold 365mc liable or disseminate claims of dissatisfaction based on subjective judgment (as opposed to objective adverse outcomes due to 365mc's intent or negligence). Violations may give rise to liability for resulting damages.
Article 15 (Dispute Resolution)
For matters not stipulated herein or disputes concerning interpretation or application of these Terms, the laws of the Republic of Korea shall apply, and jurisdiction is determined based on the location of the relevant Branch of 365mc.
Article 16 (Effect of Re-registration, etc.)
If a user re-registers at any 365mc Branch or moves to another Branch for treatment, these Terms shall continue to apply without a separate consent process.
Addenda (Effective Dates)
- These Terms took effect on June 16, 2013.
- Revised and effective on June 1, 2017.
- Revised and effective on June 1, 2018.
- Revised and effective on December 1, 2018.
- Revised and effective on July 1, 2019.
- Revised and effective on January 1, 2022.
