Chapter 1. General Provisions
Article 1 (Purpose)
These Terms of Use ("Terms") set forth the rights, obligations, and responsibilities between 365mc Obesity Clinic ("the Clinic") and users ("Members") in relation to the registration, use, and management of the services provided through the 365mc Obesity Clinic Website ("the Website"), as well as other related matters necessary for its operation.
Article 2 (Definitions)
- "User" means any person who accesses the Clinic's Website and uses the services provided under these Terms, including both Members and Non-members.
- "Member" refers to any individual who provides personal information to register on the Website, thereby gaining continuous access to the Website's information and services.
- "Non-member" means a person who uses the Website's services without registering as a Member.
- "Personal Information" refers to any information that can identify an individual, such as name or resident registration number, and includes information that can be easily combined with other data to identify a specific individual.
Article 3 (Disclosure and Amendment of the Terms)
- The Clinic shall post these Terms, along with its name, address, and contact information (telephone, fax, email, etc.), on the Website's main page for users to easily view.
- The Clinic may amend these Terms to the extent that such revisions do not violate applicable laws.
- If the Terms are amended, the effective date and reasons for amendment shall be announced on the Website's main page at least seven (7) days before the new Terms take effect.
- The amended Terms apply only to contracts established after the effective date. Contracts entered into prior to the amendment remain subject to the previous version unless the user consents to the new Terms within the notice period.
- Matters not stipulated in these Terms or interpretations thereof shall follow relevant laws or established practices.
Article 4 (Provision and Modification of Services)
The Clinic provides the following services through the Website:
- Online medical consultation and reservation services
- Online inquiry and counseling services
- Any additional services the Clinic may determine and provide
- The Clinic may modify the content or scope of services when unavoidable and will announce any such changes at least seven (7) days in advance.
- The Clinic shall not be liable for any damages resulting from service modifications unless caused by willful misconduct or gross negligence.
Article 5 (Suspension of Services)
- The Clinic may temporarily suspend services in cases of maintenance, system replacement, communication failure, or force majeure.
- In such cases, the Clinic will notify users according to Article 10.
- The Clinic shall not be liable for any damages resulting from temporary service suspension, except in cases of intentional or gross negligence.
Article 6 (Service Fees)
- All Website services are provided free of charge to registered Members.
- If the Clinic decides to introduce paid services, the details, policies, and fees will be announced in advance.
Chapter 2. Membership Registration and Termination
Article 7 (Types of Members)
All Members are subject to the same membership rights and obligations.
Article 8 (Membership Registration)
- A user applies for membership by completing the registration form prescribed by the Clinic and indicating consent to these Terms.
- The Clinic will approve the application unless the applicant falls under any of the following:
- The applicant previously lost membership pursuant to Article 9(2) (except where reinstatement has been approved by the Clinic).
- The registration contains false information, omissions, or errors.
- The Clinic determines that registration would significantly hinder its technical operations or business.
- The membership agreement becomes effective when the Clinic's approval reaches the Member.
- If any registered information changes, the Member must immediately notify the Clinic via Customer Service → Edit Member Information.
Article 9 (Membership Withdrawal and Disqualification)
- A Member may request withdrawal at any time, and the Clinic will process the withdrawal immediately. Withdrawal must be requested via Customer Service → Withdraw Membership, and the requester must provide name, password, resident registration number, and reason for termination.
- The Clinic may disqualify a Member if any of the following apply. In such case, the Clinic will notify the Member and provide an opportunity to explain before deregistration:
- False information was provided at registration.
- The Member obstructs other users' Website use or misappropriates their information.
- The Member sells unapproved items or posts unverified false information on the Website.
- The Member uses the Website to perform unauthorized medical acts or to advertise/defame in connection with medical acts.
- The Member alters information provided on the Website or otherwise interferes with its operation.
- The Member engages in acts that violate laws, these Terms, or public morals through the Website.
- The Member violates these Terms.
- The Clinic otherwise deems continued membership inappropriate.
Article 10 (Notices to Members)
- The Clinic may send notices to the email address submitted by the Member.
- All civil and criminal liability arising from the Member's submission of an incorrect or outdated email address lies with that Member.
- For notices to an unspecified number of Members, posting on the bulletin board for at least seven (7) days may substitute for individual notice.
Chapter 3. Protection of Personal Information
Article 11 (Collection of Personal Information)
The Clinic collects only the minimum personal information necessary to provide services. The following are required, with other items optional:
Name, resident registration number, ID, nickname, password, contact number, address, email address, mailing subscription status, SMS subscription status.
These are used for identity verification for complaint handling related to service use, real-name verification through a credit rating agency, prevention of misuse, etc.
The Clinic obtains the user's consent when collecting personal information, except in the following cases:
- Where a special provision of law exists.
- Where necessary to perform the service-use agreement.
Article 12 (Restrictions on Use and Provision of Personal Information)
Provided personal information shall not be used for purposes other than those consented to by the Member, nor provided to third parties without consent; the Clinic bears all responsibility for violations. However, exceptions apply where:
- A special provision of law exists.
- Provision is necessary for service delivery such as shipping.
- Information is provided in a form that cannot identify a specific individual for statistics, academic research, or market surveys.
Article 13 (Member Rights Regarding Personal Information)
- A Member may request access to and correction of their personal information.
- Requests for access/correction under Paragraph 1 may be made via Customer Service → Edit Personal Information.
Article 14 (Clinic Obligations Regarding Personal Information)
- The Clinic limits and minimizes the number of administrators responsible for personal information and implements necessary technical measures to ensure security against loss, theft, leakage, or alteration.
- The Clinic is not liable for damages from loss, theft, leakage, or alteration of personal information unless due to the Clinic's willful misconduct or gross negligence.
- Where the Clinic must obtain a Member's consent under Article 12(1), it shall clearly state or notify, in advance, the identity of the personal information manager (affiliation, name, phone number and other contact details), the purposes of collection and use, and details regarding provision to third parties (recipients, purposes, and items provided), as required by Article 16(3) of the Act on Promotion of Information and Communications Network Utilization, etc.
- The Clinic or any third party that received personal information from the Clinic shall promptly destroy the information once the purpose of collection is achieved.
Chapter 4. Services Provided by 365mc
Article 15 (Appointment Services)
- Members may use appointment services through the Website if they wish.
- All Members have a duty of good faith regarding their pre-scheduled appointments.
- The Clinic bears no civil or criminal liability for losses arising in connection with appointment services, except in cases of willful misconduct or gross negligence.
Article 16 (Consultation Board Services)
- The Clinic bears no civil or criminal liability for any losses arising from users' decisions based on consultation board services, except in cases of willful misconduct or gross negligence.
- If an online consultation leads to actual medical treatment, the Clinic bears no legal responsibility for any related issues.
- Consultation content is public by principle; however, if the Member requests confidentiality when posting a question, it will not be disclosed.
- The Clinic is not responsible for damage to consultation content due to:
- Password leakage caused by the Member's negligence;
- The Member's use of the "Delete Consultation" function;
- Force majeure or other unavoidable events.
- Consultation content may be used in a form that does not identify specific individuals for the following purposes:
- Academic activities;
- Publications such as printed materials and CD-ROMs;
- FAQs and other service content;
- Other purposes deemed necessary for the Clinic's business.
- The Clinic may refuse consultation requests that:
- Use expressions contrary to common sense or are inappropriate;
- Seek formal diagnostic names;
- Ask about drug prices or matters unrelated to the services.
Chapter 5. Obligations of the Clinic and Users
Article 17 (Obligations of the Clinic)
- The Clinic shall not engage in acts prohibited by law or contrary to public morals and will endeavor to provide continuous and stable services in accordance with these Terms.
- The Clinic shall take technical and managerial security measures to protect Members' personal information, including credit information, and make every effort to ensure information security.
- The Clinic shall maintain fair and sound operations to uphold order in e-commerce and contribute to the development of internet business by providing quality services through continuous R&D to maximize customer satisfaction.
- The Clinic shall not send unsolicited commercial emails to Members.
Article 18 (Member ID and Password)
- Members must use their ID and password when using the Website.
- Except as provided in Articles 11 and 12, responsibility for managing IDs and passwords lies with the Member.
- Members must not permit third parties to use their ID or password.
- If a Member recognizes that their ID or password has been stolen or is being used by a third party, they must immediately notify the Clinic and follow the Clinic's instructions, if any.
Article 19 (Member Obligations)
Members must not engage in the following acts:
- Registering false information at application or change;
- Altering information posted on the Website;
- Transmitting or posting information (such as computer programs) other than as determined by the Clinic;
- Infringing the copyrights or other intellectual property rights of the Clinic or third parties;
- Defaming or interfering with the business of the Clinic or third parties;
- Publicly posting or displaying obscene or violent messages, images, or sounds, or other information contrary to public morals;
- Providing or arranging health treatment and consultations for other users;
- Promoting or defaming third parties' medical practices;
- Selling or brokering the sale of goods;
- Any other acts deemed inappropriate by the Clinic.
If information deemed inappropriate for Website operation is posted on the Website or on linked sites, the Clinic may delete such information or sever the link without the consent of the user or the party who posted the information.
Chapter 6. Miscellaneous
Article 20 (Copyright and Restrictions on Use)
- Copyrights and other intellectual property rights to works created by the Clinic belong to the Clinic.
- Members shall not use, for commercial purposes or allow third parties to use, any information obtained through the Website by means of reproduction, transmission, publication, distribution, broadcasting, or other methods without the prior consent of the Clinic.
Article 21 (Dispute Resolution)
- Except as otherwise provided in these Terms, disputes arising in connection with the use of services shall be resolved through mutual consultation to the greatest extent possible.
- If a Member has complaints or wishes to submit opinions regarding Website use, they may submit them to the Clinic by email.
- Where a complaint or opinion submitted by a Member is deemed legitimate, the Clinic will address it as a priority. If prompt handling is difficult, the Clinic will promptly notify the user of the reason and expected schedule for processing.
Article 22 (Jurisdiction and Governing Law)
Lawsuits arising from disputes between the Clinic and Members relating to the use of services shall be brought before the court designated by the Clinic, and governed by the laws of the Republic of Korea.
